Washington – The Computer & Communications Industry Association submitted comments to the Japan Fair Trade Commission (JFTC) in response to its request for public comments on proposed revisions to the Business Combination Guidelines.
CCIA’s comments welcomed the JFTC’s efforts to modernize the Guidelines and recommended refinements to promote transparent, predictable, and evidence-based merger review. CCIA encouraged the JFTC to ensure that forward-looking theories of harm are supported by reliable evidence, give appropriate consideration to efficiencies and other procompetitive benefits, and narrowly tailor remedies and monitoring requirements to identified competitive concerns. CCIA also recommended applying comparable evidentiary standards when assessing predicted competitive harms and dynamic efficiencies.
CCIA has advocated for a competitive technology sector for more than 50 years.
