Brussels, BELGIUM — In advance of the next Trilogue meeting on a proposal for an Audio-Visual Media Services Directive (“AVMSD”), tech associations including the Computer & Communications Industry Association, Digital Europe, EDiMA, EMOTA and EuroISPA sent a joint-letter, raising critical issues to be addressed for the AVMSD to allow for growth within the European audiovisual industry.
The signatories strongly call on the European co-legislators to ensure that the integrity of the Country of Origin principle – cornerstone of the AVMSD – is maintained during the Trilogue negotiations, including for Video-on-Demand services and for the new obligations on Video-Sharing platforms.
The signatories also urge the European co-legislators to bring advertising provisions in line with the current European legislation and case law on online intermediaries’ liability.
More generally, the signatories ask as well for legal clarity in the final compromise, in order to avoid any unnecessary fragmentation within the Digital Single Market due to Member States adopting stricter rules than the ones adopted at the European level.
