CCIA and Allied for Startups today sent a joint letter to the Slovak Ambassador to the EU, Peter Javorčík. Our letter warns that an amendment to Slovak tax law poses a significant barrier to achieve a European Digital Single Market, especially for startups in Europe.
It more importantly violates a number of EU laws, namely; the principle of territoriality, the freedom to provide services, the freedom to conduct a business, the principle of sincere cooperation, the principle of legal certainty, the principle of fairness and equal treatment, treaties on double taxation and international definitions of permanent establishment for tax purposes.
We respectfully urge the Slovak government to reconsider this controversial amendment to avoid harming startups in Europe, the EU Digital Single Market, and avoid infringing EU law.
