CCIA Files Amicus Brief Supporting Fair Use

Washington – The Computer & Communications Industry Association, joined by co-amici Chamber of Progress and NetChoice, has filed an amicus brief in support of ROSS before the Court of Appeals for the Third Circuit following a controversial opinion in a fair use case with potential implications for AI development. The brief points out that the district court’s flawed ruling runs counter to longstanding copyright law and the appeals court should reverse the ruling to avoid thwarting innovation and competitiveness in AI.

“All four fair use factors clearly support a finding of fair use. While this is not a generative AI case, as one of the first appellate proceedings regarding fair use and machine learning, the Third Circuit has the opportunity to ensure the preservation of U.S. innovation and competition in this important space.”
