CCIA Files Amicus Brief Supporting Apple’s First Amendment Rights

Washington — The Computer & Communications Industry Association, together with fellow trade organization NetChoice, has filed an amicus brief with the Ninth Circuit Court of Appeals to support Apple’s appeal of the district court’s decision in Epic Games v. Apple. The brief focuses on the First Amendment implications of the injunctive relief, which would force Apple to display links and descriptions for In-App Purchases in a particular manner.  CCIA previously submitted a brief supporting Apple’s request to put the injunction on hold during this appeal, but the Ninth Circuit denied that request.

“A court order forcing a party to speak in a prescribed way is just as problematic under the First Amendment as a law passed by a legislative body. The injunction against Apple contains restrictions on speech that deserve the most stringent review. Apple should remain free to speak of its own products and services as it chooses.”
