New study examines EU and U.S. privacy protections

A new report by law firm Sidley Austin, released today, compares EU and U.S. privacy laws and find them “essentially equivalent”.

The recent Court of Justice of the European Union ruling declared that a new Safe Harbour framework requires a finding that the level of protection of fundamental rights and freedoms in the U.S. is “essentially equivalent” to that in the EU.  The European Commission and supervisory authorities are currently comparing EU and U.S. legal systems in expectation of a new framework for transatlantic commercial data flows.  The report concludes that EU and U.S. systems are “essentially equivalent” thus paving the way for continued data flows.
